GENERAL RULES AND REGULATIONS The Ultimate Corn & Apple Giveaway Contest

APPLICATION

These General Contest Rules apply to contests that are sponsored and administered by The Morden Corn & Apple Festival for any of its properties and related social media accounts. There may be specific contest rules associated with a particular in which case those specific contest rules will apply.

By participating or attempting to participate in a contest governed by these General Contest Rules (“Contest”), you will be deemed to have received, understood, and agreed to these General Contest Rules.

The Morden Corn & Apple Festival will also be known as ‘The Festival’ in this document. 

ELIGIBILITY

The Contest is open only to Manitoba residents who have reached the age of majority as of the date of entry. Prize will be draw on August 14th and must be claimed by August 16th, 2024.

Employees, representatives and agents of The Festival and Decor Cabinets and its affiliates, and advertising and promotion agencies, as well as the immediate family members (spouse, children, parents and siblings) and those living in the same household of such employees, representatives and agents are not eligible to enter.

In certain cases, minors under the age of majority will be permitted to enter the Contest and be eligible to win the prize(s). In no case, however, will a minor be declared a winner without the prior written consent and release of liability of the minor’s parent or legal guardian.

HOW TO ENTER – ONLINE

There is no purchase necessary to enter the Contest.

Enter the contest by clicking on the “Enter Contest Here” or comparable button on the website and enter the required information. No Entries will be accepted after the entry expiry. Upon submission of your entry online, you may be entered in the Contest for the Draw Period in which your entry is received, subject to eligibility and qualification.

Winners will be chosen by random draw, unless specified otherwise. The Winner must answer a basic math skill testing question. 

VALUE

No Prize may be exchanged for cash, sold, or transferred to any third party. The Value of The Ultimate Corn & Apple Give Away is $1700.00

ODDS OF WINNING

The odds of winning the Contest are dependent on the number of entrants attempting to enter the Contest at any given time. If applicable, the Contest may permit entrants to submit multiple calls, ballots or entries and which may increase the entrants’ odds of winning.

LIMITATION OF LIABILITY

The Morden Corn & Apple Festival is not responsible for any lost, late, illegible, incomplete, falsified, destroyed, or failed entries, or for any electronic miscommunications or failures of any kind, which may limit an entrant’s ability to participate in this Contest. Proof of submitting an entry is not proof of receipt by The Morden Corn & Apple Festival. All entries become the property of The Festival and will not be acknowledged or returned. Any and all lost, late, illegible, incomplete, falsified, destroyed, or failed entries will be disqualified. No purchase is necessary to enter or win, and a purchase will not increase the odds of your winning.

The Festival is not responsible for incomplete, lost or late entries or faulty transmissions, technical computer hardware or software failures of any kind, lost or interrupted or unavailable network connections, or failed, incomplete, garbled, misrouted, scrambled or delayed computer transmission, or other errors or problems of any kind, whether mechanical, human, electronic or otherwise, which may limit or affect in any way an entrant’s ability to participate in this Contest.

Some contests can be participated in via iOS and Android apps, but are not associated with or sponsored by Apple Inc. or Google LLC.

DISQUALIFICATION, MODIFICATION, AND/OR CANCELATION

The Festival reserves the right to: (1) disqualify any entrant and void any entries of an entrant who has engaged in unsportsmanlike conduct, fraud or other misconduct relative to this Contest or otherwise attempted to tamper with or impair this Contest; and/or (2) to cancel, modify, suspend or terminate this Contest, for any reason, including if, in The Festivals sole opinion, technical failures, applicable laws or regulations, virus, bugs, unauthorized human intervention or other cause beyond The Festival’s control destroys the integrity of this Contest or otherwise corrupts or impairs the administration, security, legality, fairness or proper play of this Contest or any part thereof. Online entries must be made only by the original, manual keystrokes of the individual entrant. Use of any automated system including robotic, or form filling software to enter is prohibited and will result in disqualification of all entries by anyone using such assistance.

The Festival also reserves the right at its sole discretion to disqualify any individual found to be tampering with the entry process or the operation of this Contest, or to be acting in any manner The Festival deems to be disruptive or in violation of the Official Rules, or with intent to annoy, abuse, threaten or harass any other person. If, for any reason, this Contest is not capable of running as planned for reasons which may include, without limitation, infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, violation of applicable law or regulation or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this Contest, The Festival reserves the right at its sole discretion to cancel, terminate, modify or suspend this Contest in whole or in part.

RELEASE OF PRIVACY RIGHTS

By participating, entrants agree: (1) that The Festival may use winner’s name, city of residence, photograph, image and/or likeness for advertising and other promotional purposes, without further review or compensation, in any media, in perpetuity and worldwide; and (2) to hold The Festival, its parent, divisions, affiliates, advertising and promotion agencies and other agents, and their respective directors, officers, employees, representatives, agents and assigns harmless against any and all claims, loss, liability, injury or damage to entrant or any other person or entity due in whole or in part, directly or indirectly, by reason of their acceptance, possession or use of a prize or their participation in this Contest. 

GENERAL

Prize winners shall be responsible for all costs and expenses not explicitly stated to form part of the prize, including but not limited to taxes, fees, gratuities, insurance, or travel to and from the airport where a prize includes travel unless anything contrary is expressly provided for in the description of any such prize.

Where the prize includes travel, the prize winner must ensure that the winner and their chosen companion(s), if any, have all the necessary travel documents required to travel to the destination on the dates specified in the prize description. The costs of any such required documents are not included in the applicable prize unless expressly provided for in the description of any such prize. The winner and their chosen companion(s) shall be solely responsible for the cost of such documents.

The Festival may at its sole discretion substitute a prize or a portion thereof with an alternate prize of similar nature of equal or greater value. Notwithstanding the foregoing, The Festival shall not be responsible to substitute a prize or portion thereof where such prize cannot be redeemed due to factors beyond its reasonable control.

The Festival reserves the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest, in whole or in part, in the case of the occurrence of an event, an error or any human intervention that could corrupt or affect the administration, safety, impartiality or the running of the Contest as provided in these Rules.

All decisions of The Festival or those of their representatives regarding this Contest are final and binding.

The Contest is subject to all federal, provincial and municipal laws. The Contest and the Official Rules will be exclusively governed and construed in accordance with the laws of the province of Manitoba. Any dispute arising hereunder shall be governed by the laws of Manitoba and shall be adjudicated in the applicable court.

The winner also agrees to abide by any rules and regulations for pick up or delivery of any prize won, any such rules to be provided by The Festival for a particular Contest prize.
