FARMERS’ MARKET TERMS & CONDITIONS

1. APPLICATION ACCEPTANCE
Submission of an application does not guarantee acceptance into the Morden Corn & Apple Festival Farmers’ Market. All applications are subject to review and approval by Festival management. If accepted, vendors will receive a confirmation email along with an invoice for applicable fees. A vendor is not considered confirmed until full payment has been received and processed.
2. FEES & PAYMENT
Farmers’ Market spaces are $500.00 per space for the full weekend, or $165.00 per day. All fees must be paid in full by July 31. Applications accepted within one month of the Festival date will require immediate payment in full. Failure to submit payment on time may result in cancellation of the space allocation.
Any vendor that have registered their spots in the Farmers’ Market at the previous rates, as of the date of this revise policy shall be maintained at the lower rate invoiced to them, provided the spot(s) are paid in full by July 31.
3. CANCELLATION & REFUNDS
Cancellations must be submitted in writing to info@cornandapple.com. Refunds will only be issued if the cancellation request is received at least 60 days prior to the first day of the Festival. Requests received within 59 days of the Festival may only be eligible for a refund if the Festival is able to reassign the space to another vendor. All refunds are subject to Festival approval and processing.
4. SPACE ASSIGNMENT & USE
All vendors will be assigned a designated 10ft x 12ft space. Vendors must remain within their allotted space at all times. No equipment, signage, merchandise, or structures may extend beyond the assigned boundaries, including walkways or neighbouring vendor areas. Encroachment may result in removal from the Festival without refund and/or additional penalties.
5. OPERATING HOURS
Vendors are required to operate during all designated Farmers’ Market hours as set by the Morden Corn & Apple Festival. Vendors must remain open to the public with a competent attendant present at all times. Early closure or late opening without prior approval may result in a $150.00 fine per occurrence and may affect future participation eligibility.
6. COMPLIANCE WITH LAWS & HEALTH REGULATIONS
Any vendors selling sealed alcoholic beverages must register for a Farmers’ Market vendor space, as required by the Liquor, Gaming and Cannabis Authority of Manitoba (LGCA). Once payment for the vendor space has been received, a confirmation letter will be issued. This letter may then be used to support the vendor’s application for the necessary LGCA permit.
All vendors must comply with applicable Manitoba Health regulations and any requirements set by Public Health authorities. Vendors are responsible for ensuring all permits and approvals are valid and submitted by required deadlines. Non-compliance may result in immediate removal from the Festival without refund.

7. PROHIBITED ITEMS
The sale of cotton candy, and any other items designated as exclusive Festival offerings is strictly prohibited within the Farmers’ Market area. Additional prohibited items include any goods not permitted under Manitoba law, including hazardous, unsafe, or restricted products. Vendors found in violation may be required to cease sales immediately and may face removal without refund and/or future ineligibility.
8. LIABILITY & INDEMNIFICATION
Any vendor that are selling produce, including corn, at the Farmers’ Market are expected to offer top quality products. The festival is not responsible to address any customer complaints about product quality of the produce sold at the Farmers’ Market
The Vendor assumes full responsibility for any loss, damage, injury, or claim arising from their participation in the Farmers’ Market. The Vendor agrees to indemnify and hold harmless the Morden Corn & Apple Festival, including its officers, employees, volunteers, contractors, and agents, from any claims, damages, or liabilities arising from their operations, conduct, or presence at the Festival.
9. SAFETY & CONDUCT
The Festival reserves the right to immediately terminate participation for any vendor engaging in unsafe, unlawful, or inappropriate conduct, as determined by Festival management. Any such termination may result in forfeiture of fees paid and removal from the Festival grounds.
10. FINAL AUTHORITY
All decisions made by the Morden Corn & Apple Festival regarding vendor eligibility, placement, compliance, and enforcement of these Terms & Conditions are final and binding.
